AIBE Eligibility Criteria

All India Bar Examination (AIBE) XIX (19) Eligiblity Criteria 2024 - Bar Council of India (BCI) is in charge of developing the eligibility requirements for the All India Bar Examination, which is required of all lawyers.

Only applicants who will meet the AIBE eligibility 2024 requirements will be permitted to take the AIBE Exam 2024. The minimum academic qualification, age limit, and registration  with the State Bar Council are all mentioned in the Bar Council exam eligibility criteria. Before completing the AIBE 19 online application form, candidates must review the AIBE eligibility criteria 2024.

The All India Bar Examination (AIBE), the law practice qualifying exam, is now held at least once a year for the issuance of the Certificate of Practice (CoP). AIBE 19 will conducted offline using pen and paper. Those who meet the AIBE requirements are granted permission to practice law. The AIBE (19) examination will be held in the month of Devember, 2024.

AIBE 19 Eligibility Criteria

Unless and until BCI Changes the AIBE 19 eligiblity conditions, they will remain unchanged, Here are the AIBE exam eligiblity requirements.

AIBE XIX (19) Academic / Education Qualification 

Candidates applying for AIBE XVIII (18) should hold 3 years or 5 years LL.B.

degree from a BCI recognized law school. One should note that there is no minimum percentage to qualify in the examination in order to register for the AIBE exam.

Candidates must have completed their graduation programme after July, 2024.

AIBE Age Limit And Number of Attempts

Candidates should note that there is no upper or lower age limit to appear for AIBE XIX (19) Exam. They should also note that there is no restriction on the number of attempts for AIBE. One can appear for the AIBE exam any number of times.

AIBE hopefuls sometimes inquire whether there is a limit to the number of bar examination tries. BCI, on the other hand, has made it known to all law graduates that:

They can take the AIBE exam as many times as they like till they pass.

They can try AIBE even after failing numerous times.

As a result, they can take the AIBE Examination as many times as they until they reach the requisite minmum score. Candidates must, however, qualify for AIBE within two years after their provisional enrollment with the State Bar Council.

AIBE Enrollment with State Bar Council 

It is mandatory for all the law graduates/aspirants to enrol with their respective State Bar Council to appear for the AIBE exam. One should enrol as advocates with their State Bar Councils, under Section 24 (1) (f) of Advocates Act, 1961.

in 2017, BCI sated that applicants enrolled with the State Bar Councils are eligible to appear for AIBE X. "The office of the Bar Council of India is receiving various queries from different State Bar Councils, seeking clarification as to whether an advocate who has been enrolled for more than two years on State Bar Council Roll, can be allowed to appear in All India Bar Examination X or not.

"according to the exam authority's notiifcation.

It is hereby reiterated and clarified that any Advocate who graduated after July 01, 2010 may appear in the All India Bar Examination as many times as necessary to pass such exam, regardless of whether he or she has been enrolled as an Advocate on a State Bar Council Roll for more than two years. The concerned Advocate is only prevented from practising as an advocate if he or she is unable to clear / pass the All India Bar Examination after two years of being enrolled as an Advocate on a State Bar Council Roll. Thus, an advocate on a State Roll is not prevented from takin gthe All India Bar Examination, and Resolution No.

According to General Council of the Bar Council Resolution 73/2010 dated 30 Spril, 2010, an unsuccessful candidate may sit in the All India Bar Examination without any limit on the number of times, until he or she clears / passes such exam."

As a result, candidates who have been members of the State Bar Council for more than two years are also eligible to take the AIBE exam to achieve CoP.

AIBE Eligibility Criteria for obtaining COP

Candidates who take the AIBE Test must acquire the minimum qualifying marks given by BCI in order to be eligible for the issuance of a Certificate of Practice. The minimal marks required for AIBE COP eligibility are as follows:

Candidates from the General / OBC category must acquire at least 40% of the overall AIBE exam results.

Candidates from the SC/ST/PwD Categories must score at least 35% on the AIBE Exam.

AIBE 19 Eligibility Criteria for Disabled / Physical Challenged candidates

The academic eligibility standards for AIBE applicants who are physically challenged or impaired are the same as for all other applicants; however, such individuals must ensure that they have:

A Certificate of incapacity issued by a medical authority.

The disability certificate should list 50% or more disabilities in specifed categories such as blindness, severed arms, or any other physical incapability.

This is required if candidates desire to increase their exam duration by 20 minutes every hour, resulting in an extra hour for AIBE exam duration.

Important

Candidates have to pass the AIBE Examination within two years from the completion of graduation. If the candidate is unable to pass the examination within two years of graduation. He/She will have to register/enroll with the State Bar Council to appear in the AIBE Examination.
