For ages, the rights of women were curbed with the 'Talaq' law. According to the practice that prevails, Muslim women are being divorced by men through mediums as easy as SMS and phone calls if they uttered or wrote the word 'Talaq' thrice. But not anymore in India!

Knowledge of laws and rights can empower Muslim women as India has proven to be a country that protects them. The main petitioner who pursued a case against the law was Shayara Bano, who was divorced through a speed post that had talaq written three times on it. Bano has fought for the rights of thousands of other victims who were abused and met out with injustice in the false name of religion.

What does the triple talaq ban say?

A judgement has been declared by the Supreme Court of India, directing the Parliament of India to pass a resolution to act against those who misuse Talaq system to get away from their marriage commitment. A jury comprising of judges from five different religions have passed the judgement, which the central government Ministers and many others have welcomed by means of bytes and tweets.

What is the real talaq system?

According to the real talaq system, triple talaq is a process that is completed over a period of three months, and not an event that can take place in an instant. However, it was being misused and abused by men to their convenience.

Muslim Law Versus Constitutional Law

In a conflict between a personal law and the law of the land, the law of the land will be prioritised and enforced. According to the Constitution all the citizens will be equal in the eyes of the law irrespective of the religion.

It is to be noted that even Muslim nations such as Pakistan and Bangladesh have discarded the practice. Will Muslims adhere by this law in India is now for the country to witness and Islam to testify its justice in this democratic country.
