11 October 2022 Daily Current Affairs: 50th Chief Justice of India, Collegium, India votes against Russia

Justice D Y Chandrachud is set to be the new and 50th Chief Justice of India

The outgoing CJI UU Lalit - who will retire on 8 November 2022 - is going to recommend Justice DY Chandrachud as his successor to the central government.

11 October 2022 Daily Current Affairs

The current CJI Lalit is serving as the 49th Chief Justice of India since 27 August 2022.

As per tradition, the seniormost judge of the Supreme Court becomes CJI. So once the current CJI - seniormost judge - retires, D Y Chandrachud takes his place as the most senior judge in the apex court of India.

A new CJI is appointed by the President upon the recommendation of the Collegium System headed by the current CJI.

Son of longest serving CJI

  • Justice DY Chandrachud is the son of the longest-serving CJI of the nation Yeshwant Vishnu Chandrachud.
  • His father served as the CJI for a record 7 years and 139 days from 22 February 1978 - 11 July 1985.

How long will he serve as CJI?

  • DY Chandrachud will serve as the CJI for a little over two years until November 10, 2024.

What is the Collegium System?

  • Collegium is a body composed of the five senior-most Judges of the Supreme Court of India.
  • They are the ones who appoint Judges in the Higher Courts - Supreme Court & all the High Courts.
  • And this system of appointing judges in the higher courts is known as the Collegium System.
  • Surprisingly it doesn't take its validity from any law made by the parliament or some constitutional provision; it has rather evolved through judgments of the Supreme Court itself.
  • A High Court collegium is led by the incumbent Chief Justice and two other seniormost judges of that court.
  • The collegium system evolved out of a series of judgments of the Supreme Court that are called the "Judges Cases".

Criticism of the Collegium System

  • The system has often been criticized for being non-transparent and for fostering nepotism as hardly anyone knows on what basis the appointees' names are decided.

107 UN member countries including India voted in favour of an open ballot on the proposal. Only 13 nations voted in favour of 'Secret Ballot' while 39 countries - surprisingly including Russia and China - abstained. Just the last month, India had abstained while Russia vetoed a UN Security Council draft resolution condemning Moscow's “illegal referenda” held in four Ukrainian provinces of Luhansk, Donetsk, Zaporizhzhia and Kherson. Later, Russia formally and legally annexed those four provinces.
