Madras High Court bench has ruled that candidates obtaining Post Graduate degrees in Tamil medium are entitled for recruitment as per an act passed in the year 2000 and it was immaterial if they had done the undergraduate course in English.
This is 'Benefit of preferential right as per the Tamil Nadu appointment of preferential basis in the services under the State of persons studied in Tamil Nadu Medium act,2000.'
Allowing two petitions, Justice S Nagamuthu said it is immaterial if they had undergone UG course in English medium and PG in Tamil medium.
For appointment as PG assistants by TRB under the preferential basis, it was enough if they did PG course in tamil medium.
"It is suffice that the candidates have studied the post-graduate and bachelor of education courses in Tamil medium. The medium of instruction in under graduate course is immaterial (for recruitment)," he said.
The petitioners contended that though they had got their under graduate degrees in English medium, they had obtained their PG degrees in Master of Commerce and B.Ed degrees with Tamil as their medium of instruction.
They had passed written exam and attended the certificate verification conducted by TRB for selection of PG assistants in commerce on Oct 23 2013.
But their candidature under the preferential right as per the 'Tamil Nadu appointment on Preferential Basis in the services under the State of persons studied in Tamil Medium Act' were rejected on the ground that they had completed their under-graduate courses in English medium.
The deputy secretary of school education department in his counter contended that candidates who had obtained all their degrees in Tamil medium were alone entitled for recruitment by TRB under the Act.
Justice Nagamuthu also directed the TRB to appoint the petitioners as post-graduate assistants if they satisfied the other qualifications required.
