KAS 2013 : Law Syllabus
The KPSC (Karnataka Public Service Commission) , established in 1951 under the provisions of the Constitution, recruits candidates to the various civil services across the state.

The selection is done on the basis of marks scored by candidates in the commission's examination ( preliminary and main) and personality test.

PAPER -1

I. Constitutional Law of India

  • Nature of the Indian Constitution, the distinctive features of its federal character.
  • Fundamental Rights; Directive Principles and their relationship with Fundamental Rights; Fundamental Duties.
  • Right to Equality
  • Right to Freedom of Speech and Expression;
  • Right to Life and Personal Liberty.
  • Religious, Cultural and Educational Rights.
  • Constitutional position of the President and relationship with the council of Ministers.
  • Supreme Court and High Courts, their power and jurisdiction.
  • Union Public Service Commission and State Public Service Commissions, their powers and functions.
  • Principles of NaturalJustice.
  • Distribution of Legislative powers between the Union and the States
  • Delegated legislation; its constitutionality, judicial and legislative controls
  • Administrative and financial Relations between the Union and the States.
  • Trade, Commerce and intercourse of India.
  • Emergency provisions.
  • Constitutional safeguards to civil servants.
  • Parliamentary privileges and immunities.
  • Amendment of the Constitution.

II. International Law

  • Nature of International Law.
  • Sources; Treaty, Custom, General Principles of Law recognized by civilized nations, Subsidiary means for the determination of law, Resolutions of International Organs and Regulations of Specialised Agencies.
  • Relatonship between International Law and Municipal Law.
  • State Recognition and State Succession.
  • Territory of States; modes of acquisition, boundaries, International rivers.
  • Sea, Inland waters, Territorial sea, Contiguous Zone, Continental Shelf, Exclusive Economic Zone and Ocean beyond national jurisdiction.
  • Air-space and aerial navigation.
  • Outer-space : Exploration and use of Outer space.
  • Individuals, Nationality, Statelessness; Human Rights and procedures available for their enforcement.
  • Jurisdiction of States; basis of Jurisdiction, immunity from jurisdiction.
  • Extradition and Asylum
  • Diplomatic Missions and Consular Posts.
  • Treaties; Formation, application and termination.
  • State responsibility
  • United Nations; its Principal organs, Powers and functions.
  • Peaceful settlement of disputes.
  • Lawful resource to force; aggression, self defence, intervention.
  • Legality of the use of nuclear weapons; ban on testing of nuclear weapons; Nuclear
  • Non-proliferation Treaty.

PAPER - II : Law of Crimes and Torts, Law of Crimes

  • Concept of Crime; actus, ream, mens rea, mens rea in statutory offences, punishments, mandatory sentences, preparation and attempt.
  • Indian Penal Code :a) Application of the Code (b) General exceptions (c) Joint and constructive liability (d) Abetment (e) Criminal conspiracy (f) Offences against the State (g) Offences against Public tranquility (h) Offences by or relating to public servants (i) Offences against human body (j) Offences against property (k) Offences relating to marriage; cruelty by husband or his relatives to wife (I) Defamation.
  • Protection of Civil Rights Act, 1955.

  • The Monopolies and Restrictive Trade Practices Act, 1969
